In August of 2022, the PACT Act was signed into law. As part of this legislation, Veterans were given one year to submit their claim(s), or an intent to file, to have their benefits backdated to the date of the change in law.

For Veterans who weren’t ready to submit an official benefits claim during that time, an “intent to file” could be submitted. Following the intent to file, they would have one year to file the actual claim to protect the earliest effective date for their potential benefits should they be awarded. 

As of the end of May 2024, the VA report that there are still over 300,000 veterans who submitted an intent to file between June and August 2023 for PACT Act claims but haven’t completed their official filing.  If these aren’t followed up on, it could result in a significant loss of potential retroactive benefits for many Veterans.

What is the PACT act?

Can I still file for VA disability benefits under the PACT Act?

Yes, Veterans can still file for benefits under the PACT Act anytime. The only difference at this stage will be the effective date of the claim. If you are awarded, it won’t be from the change of date in law (August 10, 2022), but rather from the date the VA received your claim.

What is an intent to file a claim?

Submitting an intent to file creates a potential start date for your VA disability benefits. This can also be done for pension benefits and Dependency and Indemnity Compensation (DIC). 

How long do I have to file my claim after I notify the VA of my intent to file?

After you submit your intent to file, you have 1 year to file your completed claim.
