Three new cancer types added to the presumptive list for service connection

Recently, the VA expanded the list of presumed service-connected disabilities due to environmental exposure under the PACT ACT.

The cancers added are:

  1. Urethral cancer
  2. Cancer of the paraurethral glands
  3. Male breast cancer

What does it mean when a condition is considered “presumptive” by the VA?

 Presumptive service connection means VA automatically assumes service connection for the disease and provides benefits to eligible Veterans who have submitted claims with evidence of a diagnosis.

Which geographic service areas are the new conditions applicable to?

This policy establishes presumptions of service connection for eligible Gulf War and post-9/11 Veterans who served in Afghanistan, Somalia, Djibouti, Egypt, Jordan, Lebanon, Syria, Yemen, Uzbekistan, and the entire Southwest Asia theater of operations, which includes Iraq.

Are there any other service locations the VA may add for presumptive conditions in the future?

The VA has outlined plans to include more locations where herbicides were stored, tested, and used.  In the proposal, locations would be added in the United States, Canada, and India for Agent Orange. This expansion would be in addition to the existing eligibility requirements for Agent Orange Exposure and disability compensation. Are there other presumptive conditions that might be added to the current list?

Veterans advocates continue to push the envelope to have more conditions made eligible for disability benefits under the PACT act. While there is no telling exactly when the list may be expanded to include other conditions, The VA remains committed to a thorough scientific review that could confirm the link between environmental exposures and other conditions. Is there a deadline that I need to file these presumptive claims by?

No, there is no deadline. You may file for benefits under the PACT act anytime. However, if you previously submitted an “intent to file” for PACT act-related claims, you may want to submit your completed claim as soon as possible to ensure you receive the most retroactive benefits you’re entitled to.
